Terms of Service

1. Agreement
These Terms of Service apply to website design, hosting, maintenance and marketing services provided by DocWeb Consulting (“we”, “us”). By using our website, or by purchasing or using our services, you agree to these terms and to our Privacy Policy.
2. Website builds and redesigns
Each website project is defined by a written scope and price that you approve before work begins. Work outside the approved scope is quoted separately. You are responsible for providing content, images and feedback in a timely way, and for having the right to use any materials you give us.
3. Hosting
The Hosting Only plan provides website hosting of up to 10GB, an SSL certificate and daily backups. It does not include software updates, edits, troubleshooting or support tickets. Edits may be available for an additional fee.
4. Maintenance plans and support tickets
Maintenance plans include the hosting features above, plus the services listed for each plan on our Products page. Each plan includes everything in the plan below it. A support ticket is a request for an edit or for help with your website. Economy includes 25 support tickets per year, Standard includes 50 per year, and Pro includes unlimited coding changes.
5. Client access and client-made changes
We generally do not provide clients with editing access to their websites, so that we can keep each site stable and secure. If you do have access and you, or anyone acting for you, make changes to the website, any work needed to find and fix resulting problems is not standard maintenance. It is not covered by a maintenance plan and will be billed separately for our time.
6. Software updates, troubleshooting and security
On maintenance plans we monitor and apply updates to software such as PHP, WordPress and plugins, troubleshoot problems, work to restore your website if it goes down, and use tools intended to protect against malware and viruses.
We provide these services with reasonable care, but we do not guarantee that your website will be uninterrupted, error-free, or free from malware, hacking or data loss. Updates to third-party software can occasionally cause problems that are outside our control.
7. Backups
Daily backups are taken to help with recovery. Backups are provided as a convenience and are not guaranteed to be complete or available in every circumstance. We recommend you keep your own copies of important content.
8. Fees and payment
Hosting, maintenance and marketing plans are billed monthly in advance to the card you keep on file with us. Website builds are billed as set out in your approved scope.
If your website needs a paid plugin, licence or other third-party product, you may either keep a card on file to pay for it directly, or we will purchase it and bill the cost back to you.
9. Cancellation
There are no long-term contracts. If you cancel, we will provide your website files, database and domain (if we manage it). Moving the website and setting it up with another provider is your responsibility.
10. Ownership
You own your domain name, your content and, once paid for in full, your website. Third-party software, themes and plugins remain subject to their own licences. Paid plugins, licences and other products that we purchase and pay for remain ours and do not transfer with your website if you leave.
11. Third-party services
Your website may rely on services from other companies, such as hosting infrastructure, domain registrars, plugins and payment processors. We are not responsible for the availability or actions of those services.
12. Disclaimer
Our services are provided “as is”. To the fullest extent permitted by law, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or any particular search ranking, traffic or business result.
13. Limitation of liability
To the fullest extent permitted by law, DocWeb Consulting is not liable for indirect, incidental or consequential damages, including lost profits, lost data or business interruption. Our total liability for any claim is limited to the recurring fees you paid us in the three months before the claim arose.
14. Changes to these terms
We may update these terms from time to time. The current version will always be available on this page.
15. Governing law
These terms are governed by the laws of the State of New Hampshire.
